Those are definitely scratches, they’re made by the bottom screen touching the top when you close it

It’s a design flaw of OG models, the borders from the bottom screen and circle pad will leave marks on the upper screen whenever you close it.
Nothing you can do other than applying a screen protector (if it doesn’t already have one) and clean it regularly.

Definitly scratches from the bottom Screen frame! I have several 3DS systems which i bought used and one of Them has this issue also. This damage usually Happens If you Close the 3DS and Put huge pressure on it. For example If you Put it in your Collage bag with books, notebook etc. in it and it presses on the DS. Then this can happen very easily.

They’re scratches, one I bought of fb marketplace had them and I thought it was smudg or something too… it’s not your better off taking it to your local game shop and trade it in for a “new” model

They definitely are; it’s a design flaw in the Old 3DS that causes the inner screen to scratch the upper screen.
You can change the screen protector; it’s very simple and fortunately doesn’t require a soldering iron or disassembling anything, but it does require a heat source and/or something to pry it off with.
