You can mod it either before or after updating.
As of this post, Nintendo has never released an update that blocks the current level of modding. In theory that may change at some point; but if Sony and the PS Vita modding community is any indication, they’ll never fix it.

The last update is quite old at this point.
There is no firmware that can’t be hacked.
If you wish to continue using Bank/Transport, you will have to update.
If you don’t wish to continue using official eshop/Bank/Transport I guess you can opt out if you’d like.

You… might want to replace your circle pad. It takes about 10 minutes start to finish, $3 for the part.
