I have a Midnight Purple 3DS that I play pretty regularly, and it doesn't have any scratches yet.
But, I just got Cooking Mama and I quickly realized that it's definitely one of those touchscreen heavy games that can scratch up the screen. I don't have a screen protector but I am considering getting one.

Depends on how deep the scratches are. But mostly no.
i’ve scratched a dsi screen by using the butt of a fork (i was 12, be nice š) to play pokemon heartgold. DESPITE THAT, the screen worked perfectly fine and those were some deep scratches
