I just bought my new 3ds xl, there is a missing rubber cover in on the upper screen, but isn't it supposed to have a screw behind this cover? Because I d'ont see one

Yes, you’re missing a 4.3 mm screw. Should be fine I would think as its just holding the back plate on.
