Just to be sure, is this battery spicy?

For more context: I bought this N3DSLL “brand new” in the box back in May, recently the battery started acting up, going from 100% to 30 in less than an hour, than suddenly going to 5 blinking, and turning it on to see it has 30% battery again, when opening up the console it looked like this
