I bought it second hand around a year ago and I’m surprised I haven’t lost it yet lol. I got other systems like the 3dsxl and the dsi and this was never a problem. Is it just that the stylus is not the og one?? I’ll add some pics of it in the comments

Yeeeeeah, its positioning means that after enough wear, the damn thing will just straight up jump out of the holster. See if you can find a replacement maybe.
No, it’s supposed to stay on it. When I bought my 3ds I had a similar problem. It didn’t fall out straight like yours, but it was pretty loose and came out pretty easily.
However, it was a pretty easy fix:
With the tip of a knife (or anything flat but slim) I slightly nudged the tip on the base of the stylus out.
Mine was slightly pressed in (as yours seems to be) and that is pretty much all that’s supposed to keep a slight pressure when you place the stylus in so it doesn’t fall off.
If you do it, do it very carefully and in small pushes so it doesn’t break.
Pic of how it looks now.

Over time the nub can get worn down enough so that it isn’t able to grab onto the sides like it’s supposed to
Take a BIC pen or something similar, and slowly wedge it in the gap of the stylus. That should stretch the plastic out enough to regain hold in the slot but not stress the plastic enough to break it. Just did this to a 3ds XL stylus two days ago
